Terms of Service

These terms apply to every order you place on this website. By placing an order you agree to them. Please read them before you buy.

1. About us and our products

We supply apparel, drinkware, bags, print and promotional items that are made to order and branded with your artwork. Product descriptions, photographs and colours are a guide. Printed colours can vary slightly from what you see on screen.

2. Placing an order

• You must be 18 or over, or ordering on behalf of a business.
• Your order is an offer to buy. We accept it when we confirm it by email, or when we start production.
• Please check your product options, quantities, artwork and delivery details before you pay. You are responsible for entering them correctly.
• We may decline or cancel an order, for example if an item is unavailable, a price is wrong, or the artwork is unsuitable. If we do, you will be refunded in full.

3. Your artwork

• You can upload PNG, JPG, SVG or WebP files up to 4MB. Higher resolution files print more sharply.
• You confirm you own the artwork or have permission to use it, and that it does not infringe anyone's copyright, trade mark or other rights, and is not unlawful, hateful or offensive.
• We carry out an artwork check and may contact you if a file is not suitable. We may refuse to print any artwork.
• We use your artwork only to produce your order. We do not use it for anything else or share it with anyone other than the people who make and deliver your order.
• You are responsible for any claim made because of the artwork you supply.

4. Prices and payment

• Prices are in pounds sterling and are shown at checkout, together with any delivery charge, before you pay.
• Payment is taken in full when you place your order. We use a secure online payment provider, Fena, to take payment by bank transfer. We never see or store your bank login details.
• Production starts once payment is confirmed.

5. Made to order, production and delivery

• Every order is made specially for you. We will give you an estimated timescale for production and delivery. Estimates are not guaranteed dates, and delays can happen.
• We deliver to addresses in the United Kingdom and Ireland. Deliveries are tracked, and we will email you tracking details when your order is dispatched.
• Risk in the goods passes to you when they are delivered. Ownership passes to you when we receive full payment.
• Please check your delivery address carefully. If a parcel is returned because the address was wrong, we may charge for sending it again.

6. Cancelling and returns

Because your goods are made to your specification and personalised with your artwork, you do not have the usual 14-day right to cancel once production has started (Consumer Contracts Regulations 2013, regulation 28). This does not affect your legal rights if something is wrong.

• Changing or cancelling before production: email us as soon as you can. If we have not started making your order we will cancel or change it and refund you.
• Faulty, damaged or not as described: if your goods arrive damaged, faulty, or not what you ordered, email us within 14 days of delivery with your order number and photos. We will repair, reprint, replace or refund, as the law requires. Your statutory rights under the Consumer Rights Act 2015 are not affected.
• Printing as supplied: if your goods are printed exactly as the artwork you approved, we are not responsible for how the finished result looks to you, for example low-resolution artwork, or the design not suiting the item.
• Refunds are made to the account the payment came from, normally within 14 days of us agreeing the refund.

7. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for losses that are not foreseeable, or for business losses such as lost profit. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

8. Events outside our control

We are not liable for delay or failure caused by events outside our reasonable control, such as supplier or courier problems, severe weather, strikes or system outages. We will tell you if this affects your order and give you the option to cancel and be refunded if the delay is long.

9. Our website

We do our best to keep the website available and accurate, but we do not promise it will always be uninterrupted or error-free. All designs, text and images on this site belong to us or our licensors and may not be copied without permission.

11. Complaints

If you have a problem, please email sales@elitebrandworks.co.uk and we will do our best to put it right quickly.

12. General

• These terms are the whole agreement between you and us for your order.
• We may update these terms from time to time. The terms in force when you place your order are the ones that apply to it.
• These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may also bring a claim in your local courts. The courts of England and Wales can deal with any dispute.
